What is a guest room?

A guest room is a furnished furnished room homestay to accommodate passing tourists for one or more nights, including breakfast. Reception is provided by the inhabitant. The guest room is located in its main or secondary residence (same main building or annex building).

The guest room is limited to a maximum number of 5 bedrooms  for a maximum reception capacity of 15 people  hosted simultaneously.

Declaration of activity

The rental of one or more guest rooms must be declared by electronic means, registered letter or deposit at the town hall of the municipality of the location of the dwelling concerned. The declaration is the subject of an acknowledgment of receipt by the town hall.

The individual police record

Le decree 2015-1002 of August 18, 2015  introduces the obligation to draw up individual police files on the arrival of foreign customers to all providers providing accommodation. They are no longer transmitted daily but must be kept for 6 months and returned at the request of the police or gendarmerie. "For the purposes of preventing disturbances of public order, judicial inquiries and research in the interest of individuals, hoteliers, operators of holiday villages and family homes, tourist residences and residential villages, rental companies furnished tourist accommodation and bed and breakfast, operators of campsites, caravans and other developed sites are required to have the foreigner complete and sign, upon arrival, an individual police form, the model of which is fixed. by joint order of the Minister of the Interior, the Minister responsible for immigration and the Minister responsible for tourism.

The decree of October 1, 2015 defines the model of the individual police record.

The host table

The owner of guest rooms can also offer a "table d'hôtes" service which corresponds to the meal service in addition to the accommodation . The table d'hôtes consists in principle of a single menu, the meal being taken at the single family table with a limited capacity, ie 15 people.

An individual wishing to create a table d'hôtes must apply for registration in the Trade and Companies Register (RCS) as soon as he exercises this activity as a usual profession (that is to say repeatedly in the aim to profit from it). On the other hand, if this activity is occasional, one-off or exceptional, it does not confer the quality of trader and does not give rise, in principle, to registration with the RCS.

If operating a table d'hôtes, if the owner does not hold a license to sell drinks to be consumed on site, he must obtain one of the two restaurant licenses defined in theitem L3331-2  of the Public Health Code:

  • the "small restaurant license" which allows the sale of drinks from the second group (non-distilled fermented drinks, such as wine, beer, cider, perry, etc.) to be consumed on the spot, but only on the occasion of the main meals and as food accessories,
  • the "large restaurant license" itself which allows all drinks to be sold for consumption on site, but only for the main meals and as food accessories

As of June 1, 2011, it is no longer necessary to hold a license to sell non-alcoholic beverages. 

In application of article L3332-1-1 of the public health code, all owners must undergo training adapted to the specific conditions of the activity.

Finally, opening a guest table requires the owner to respect training obligations.
