Owners of houses and apartments for seasonal rental, who provide a television or CD player, have received letters from Sacem asking them for a flat rate of 223,97 euros in royalties per year, reports the newspaper Le Parisien .

On his website, Sacem explains that the works (such as songs but also credits, music for films, TV series or advertising, etc.) distributed in furnished tourist accommodation, guest rooms, lodges " are the result of the work of authors, composers and music publishers who have entrusted Sacem with the task of collecting royalties and distributing them »

She relies on a judgment of the Court of Cassation of April 6, 1994 CNN v/ sté Hôtelière Novotel Paris Les Halles to affirm that audiovisual broadcasts given in the rooms of tourist accommodation establishments are considered public broadcasts. In this judgment, the Court considered that all the customers of a hotel, although each occupies a private room in a private capacity, constitute a public. Also the mere fact of providing its customers with the possibility of receiving television broadcasts constitutes public broadcasting. And to offer an annual fixed price of €198,01 excluding VAT allowing the broadcasting, “ whatever the source, in the rooms and common areas, the largest musical repertoire in the world, without any restrictions »

The host benefits from the 20% discount granted to anyone declaring their broadcasts in advance.

The amount of royalties is a single annual flat rate regardless of the operating period-covering broadcasts in bedrooms and common areas, explains Sacem, which publishes on its website the pricing of broadcasting rights in bed and breakfasts, lodges, furnished tourist accommodation, etc.
